Terms of Use

These terms apply to the Stocka app for iPhone, iPad, Apple Watch and Mac, its widgets, and this website. Stocka is made by Philip Kramer, an independent developer in Israel ("we", "us"). By using Stocka you agree to these terms.

Stocka is licensed to you under Apple's Licensed Application End User License Agreement, which governs the licence to use the app. These terms add to that agreement and explain how Stocka works. If they conflict, Apple's agreement governs the licence itself.

The short version

Not investment or tax advice

Stocka's readings — buy, hold, trim or sell, the price to act at, the stop, alerts, and its other analysis — are generated automatically on your device from public price history and the information you enter. They are general and educational. They do not take into account your full financial situation, goals or risk tolerance, and they are not a recommendation to buy or sell any security. Past results, including the app's record of its own past readings, do not predict future results.

The tax reports, including figures for Israeli Forms 1325 and 1322 and the US Form 8949 worksheet, are estimates based on the trades you record and the settings you choose. Tax rules are complex and depend on your circumstances. You are responsible for your own tax filings.

Market data and third-party content

Quotes, charts, dividends, earnings dates, analyst summaries, key statistics and news headlines are supplied by third-party providers and shown with their source where possible. We do not create or check this information and cannot guarantee that it is accurate, complete, current or available. News links open the publisher's own content, which belongs to its publisher. Do not rely on Stocka's data alone for trading decisions; confirm prices with your broker.

Your data and your broker

The trades, holdings and settings you enter stay on your device and in your own iCloud Drive, as described in the Privacy Policy. You are responsible for what you enter and for keeping your own backups. If you connect Interactive Brokers, Stocka only reads your account's records using the token you provide; it cannot place orders or move money. Your use of your broker is governed by your agreement with them.

Stocka Pro

No warranty

To the fullest extent the law allows, Stocka and everything it shows are provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and accuracy of data. We do not promise the app will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, we are not liable for any trading or investment losses, tax liabilities, lost profits, or indirect or consequential damages arising from your use of Stocka or reliance on its data or analysis. Our total liability for any claim relating to Stocka is limited to the amount you paid for Stocka Pro in the twelve months before the claim. Nothing in these terms limits rights you have under the consumer protection laws of your country that cannot be limited by agreement.

Changes

We may update these terms as Stocka changes. We will change the date at the top of this page, and note material changes in the app's release notes. Continuing to use Stocka after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv-Jaffa have jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally.
